Amended Immigration Regulations

The Federated States of Micronesia Department of Justice, Division of Immigration and Labor, proposes to adopt a new set of regulations to replace the current Immigration regulations - in their entirety, as published in 1986. These regulations are published pursuant to the authority granted by 55 FSMC §228 and under the procedures set forth in 17 FSMC §102.

These proposed regulations will updated the regulations to become compliant with current immigration laws and treaties, including the provisions regarding requirements for all non citizens, appeal procedures and exemptions for US citizens, as well as establish a system of fees for entry permits and establish a system for immigration violations.

Any person interested in commenting on these proposed regulations may do so in a written submission to the Department of Justice, Division of Immigration and Labor, P.O. Box PS 105, Pohnpei, Palikir, FSM 96941 on or before September 21, 2005.

These regulations are proposed to take effect upon compliance with Title 17 of the Code of the Federated States of Micronesia. Affected persons should assume that these proposed regulations became effective on October 01, 2005 unless they learn otherwise.

The actual date of effectiveness will be noted on the certified copies of the regulations to be filed pursuant to 17 F.S.M.C. 103(1).
